Syllabus: This unit examines mining law both in Western Australia and nationally. It discusses the constitutional allocation of legislative powers in relation to mining between the States and the Commonwealth and the key legislation that applies. Topics covered include the public and private ownership of minerals, the regulation of of mining tenements, and licences and leases for prospecting, exploration and mining, dealings with mining interests, as well as administrative law challenges to the decisions of Mining Wardens and Ministers. Royalties are also discussed.
