Syllabus: This unit discusses the main approaches to statutory interpretation, including literal and purposive approaches, and the importance of context to the interpretive understanding of legislation. The relevance of legislative history and use of extrinisic materials are covered, as well as the significance of common law maxims of interpretation and the role of common law presumptions as to parliamentary intent and meaning. Amending legislation and the reconciliation of conflicting statutory provisions, or conflicting legislative Acts, are also discussed. These issues are situated in their constitutional context, mediating the relationship between the Courts and the Parliament.
