Syllabus: This unit examines key legal principles and statutory regimes at both State and Commonwealth level which are intended to achieve the goals of sustainable development and environmental protection. Topics studied include the policy goals underpinning environmental regulation and sustainable development law, constitutional allocation of regulatory responsibility for environmental protection, the mix of regulatory, economic and voluntary measures utilised to achieve sustainability goals, the policy values underlying the choice of regulatory technique, key statutory regimes, and central environmental law principles such as the precautionary principle, inter-generational equity and the 'polluter pays' principle. Issues such as land use planning, environmental impact assessment, natural resource management and biodiversity protection are discussed. Alternative regimes in other jurisdictions, including overseas jurisdictions, are considered, as is the relationship between environmental matters and indigenous rights.
